These are the terms and conditions of sale of ValGrine, brand of the company GM DEVELOPPEMENT. These terms will apply to all purchases of goods when you order via our website www.valgrine.com or by telephone using our client service team. Please read this document carefully before placing your order.
I / Concerned documents and customers
These General Terms and Conditions govern the order in all forms, for products online on the website of the Boutique VALGRINE, www.valgrine.com between GM DEVELOPPEMENT and Customers acting for personal or professional use, excluding the purchase for resale (resellers or distributors must imperatively have signed a term sheet with VALGRINE to benefit facilities of this website). If there is no written contract between the customer and VALGRINE, these Terms constitute the entire agreement between the parties relating to the order’s subject and prevail over any other document.
These conditions apply throughout the line-up of products offered by VALGRINE.
2.1. Order’s creation:
The customer has the possibility to order online from the online boutique on the website of VALGRINE www.valgrine.com. The order can be registered on the website of the shop VALGRINE only if the customer is clearly identified by entering their email and password, which are strictly personal.
Any order implies acceptance of prices and descriptions of products available for online sale.
VALGRINE reserves the right to refuse any order from a customer in the case where a previous order has not been paid in full. Every order is considered made on the date of its receipt by VALGRINE. VALGRINE and its Customer shall refrain from invoking the requirement of an act under private signature within the meaning of the article 1341 and following ones of the Civil Code.
2.2. Order’s validity:
To place an order, the customer creates his account (login and password). This code ensures the identification of the Client. The Customer undertakes to conserve and maintain the said secret code. Therefore, the Customer solely assumes the consequences of disclosure of this code. The Customer agrees not to disclose to any third party either one or any of the elements of the access code is received by him. In case of loss of the code, the customer can request a new code under their login details.
VALGRINE and Customer recognize that computer records of their messages take the place of documentary evidence. In all cases the online provision of the credit card number and the final validation of the order will be proof of the completeness of said order and will be acceptance of these terms and conditions fully and without reservation. The invalidity of one or any of the provisions of these Terms has no effect on the validity of the order.
The records stored in the computer system of VALGRINE within reasonable security conditions, will be considered as proof of communications, orders and payments between the parties.
2.3. Order’s proof :
All orders contained on the ValGrine website implies acceptance of these Terms. Any confirmation of an order implies your full acceptance of these terms and conditions, without exception or reservation. It is expressly agreed that, in the event of a dispute between sources of information, VALGRINE’s information is agreed to be the correct one. Data on computer or electronic evidence is valid and as such, they are admissible under the same conditions and with the same probative force as any document created, received or kept in writing. You declare that you understand this. The order confirmation that is signed represents the transaction. A summary of your order information and these Terms and Conditions will be sent in PDF format via e-mail confirmation of your order.
III / Price
3.1. Prices indicated on this website ValGrine Shop www.valgrine.com are always in Euros (€), and inclusive of VAT, and excluding applicable discounts, processing fees and shipping and may change without notice. Depending on the country of delivery, the prices will change depending on the VAT rate (out of EU), applicable fees and charges at the time of reception. All orders whatever their origin are payable in euros.
3.2. Discounts or promotions cannot be combined. If applicable, the highest discount applies. The benefit of the discount applies only if the customer is identified.
IV / Payment
4.1. The customer has the choice to settle its product order(s):
– Online ordering by credit card bearing the name VISA, EUROCARD or MASTERCARD accepted in France, excluding American Express.
– By bank transfer in accordance with the commercial and financial service ValGrine.
4.2. In order to counter Internet fraud, payments through our Website will be managed on-line with banking facilities offered by Cyberplus Banque Populaire system.
We reserve the right to put in place additional/other payment security system(s) from time to time.
V / Billing
The invoice sent by mail to the customer, details the product provided or service performed and the price including discount (if any).
VI / Delivery
6.1. No delivery will take place unless payment for the Goods has been received. We will, in any event, deliver the Goods no later than 30 days after the day on which the Contract is entered into. The time of delivery indicated on the website www.valgrine.com is given as an indication only.
6.2. In case of temporary unavailability of an item ordered, VALGRINE informs the Client of this fact: unless otherwise specified by the Client, it is made five (5) business days from the date of dispatch of the information by VALGRINE, the Order is deemed confirmed. In case of technical unavailability, VALGRINE informs the Client of this fact: unless otherwise stated by the Customer, the order is considered cancelled and the latter is refunded.
6.3. If there is no one at the address provided who is able to accept delivery of the Goods, you will be asked to contact our Client Service in order to arrange an alternative delivery date to collect the Goods.
6.4. If, at the time of delivery, the packaging is damaged, please open the package in the presence of the carrier in order to verify the condition of the Goods. In the event of damage to the Goods, you should note the details on the delivery note and contact the Client Service team.
6.5. For orders to countries other than France you are the importer of the products concerned. Customs duties or other local taxes or import duties or state taxes may be required. These rights are not within the purview of the company GM DEVELOPMENT. They will be at your expense and are your responsibility both in terms of statements and payments to the authorities and relevant bodies in your country. We advise you to inquire about these aspects with your local authorities. Warning: once you take physical possession of the goods ordered, the risk of loss or damage of products are transferred to you.
VII / Your right of cancellation
When you buy goods from us, the goods must be of satisfactory quality; fit for their purpose; and as described. If they do not meet these standards, you will be able to claim a refund or replacement or repair and/or compensation from us. If there is a problem with your Goods, please let us know by contacting us.
7.1. You have the right to change your mind, end the contract and receive a refund up to the end of fourteen calendar days after you (or someone you nominate) has received the Goods.
You do not have a right to change your mind in respect of personalised Goods (e.g. engraved).
7.2. To exercise your right of cancellation before the Goods have been delivered to you, you must give notice to us by calling our Client Service Team on: +33 477 479 513 or by sending us an email to firstname.lastname@example.org. GM DEVELOPPEMENT will fully refund or re-credit you no later than fourteen (14) calendar days after the day on which we have received notice from you about your decision to cancel the order. We will refund you by the method you used for payment.
7.3. If you change your mind and end the contract for any reason after the Goods have been dispatched to you or you have received them, you must return them to us within the fourteen (14) calendar days after the day you received it.
7.4. You will be responsible for returning the Goods in their original packaging, complete with all related accessories (e.g. head protection). If Goods are incomplete or damaged, you will not receive a refund and the Goods will be sent back.
VIII / Intellectual Property Rights
8.1. The documents presented to the customer are protected by the Code of Intellectual Property. Consequently, any reproduction, distribution or communication by any means whatsoever without the prior written permission of VALGRINE or its beneficiaries constitutes infringement and liable to the penalties attached to it.
8.2. The client is reminded that that the overall structure, texts, images, sounds, know-how, drawings, graphics, computer programs and any other online store component element VALGRINE, are the exclusive property of the Group GM DEVELOPMENT. The intellectual property rights on the photographs reproduced on the Web Store VALGRINE belong to VALGRINE. In particular, and subject to the provisions of the preceding paragraph, any representation, reproduction, modification, translation and / or adaptation, total or partial, against payment or free of Online VALGRINE and component parts, by any means whatsoever, without the prior written consent of VALGRINE is prohibited and constitutes an infringement under L335-2 and following of the Code of intellectual property.

Similarly, it is also forbidden to modify the software or to use modified versions of products including (but not exclusively) to obtain unauthorized access to the service and accessing the site by another means other than the interface provided by VALGRINE for this purpose.
8.5. The brands owned by the Group GM DEVELOPMENT (name and logo) on the Site of the online store VALGRINE are registered trademarks. Total or partial reproduction of these brands, made from the website of the online store VALGRINE without the prior express consent of VALGRINE and / or Group GM DEVELOPMENT is prohibited within the meaning of the L713-2 and following of the Code intellectual property.
IX / Guarantee – Liability – Responsibility
The client must make sure that the goods received correspond to the order. If the Goods are not consistent with the order, you have to contact us by phone (+33 477 479 513) and return the items. In this case, VALGRINE is responsible for collecting your items, at your preferred address (metropolitan France)
VALGRINE does not guarantee, either expressly or implied, the suitability of use of products and information for a particular purpose, their adaptation to a specific function, accuracy or timeliness, despite the care the company brings to it.
9.1. VALGRINE can’t be held liable vis-à-vis the customer for any loss arising from the execution of the order. “All loss” particularly includes loss of profits, revenue, usage of goodwill or any similar loss, payment made or due to a third party, economic loss, inability to use the products in particular functions, and any loss or damage resulting from a delay of supply of products object of the order.
9.2. VALGRINE not be held liable vis-à-vis the Customer of any misunderstanding or misinterpretation in case of oral information.
9.3. VALGRINE also disclaims responsibility for any damage resulting from an incursion by a third party led to changes in information made available on the online store VALGRINE, and more generally for any damages, direct or indirect, whether that is the cause, origin, nature and consequences. The Customer acknowledges having knowledge of the characteristics and limitations of the Internet, particularly in terms of information data transmission via networks and data breaches. X / Privacy & Personal Data

XI / Applicable law and jurisdiction
French law governs the order and all acts arising. Any disputes arising as to the order are the exclusive jurisdiction of the courts of Saint-Etienne, even in case of multiple defendants, to appeal or interlocutory.
We advise our customers to return their putter to us every year in order to have a complete check-up.
This optional assistance provides our customers with a complete diagnosis of the state of the putter. Our team will use the opportunity to clean it and give it back its first day’s radiance.

ValGrine guarantees the quality of its golf putters. You can benefit from 14 calendar days to change your mind and return the package to the manufacture. The returned items must be presented in their original packaging (with the plastic film protecting the putter head).
If items returned are incomplete, damaged, or used, they will not be refunded.
All personalized products (e.g. engraved) will not be taken back, exchanged or refunded.
